During the summer of 2013, a 7-year-old girl apparently sustained serious head and brain trauma while she was participating in a game at a summer camp run by the City of Fremont.
According to reports, the young lady hit her head on a cement patio when her wheelchair tipped over as a camp counselor was helping her “chase” another child during a game of Duck-Duck-Goose. The family of the girl claims that the brain damage, skull fracture and other catastrophic injuries the girl sustained in the unfortunate accident were as a direct result of the camp counselor and other camp employees acting with “gross negligence, carelessness and recklessness.”
According to statements made by the family, the city was made fully aware of the fact that the girl had an existing medical condition known as hydrocephalus, which is a swelling in the brain caused by a buildup of fluid inside the skull, prior to the city agreeing to accept her in their summer camp program. The city-run summer camp was also informed that the girl’s disabilities and that she requires the use of a wheelchair to get around presented certain physical limitations.
In August 2013, the family submitted a claim to the city requesting compensation; however, their claim was denied. Then on Monday, January 27th, 2014, a lawsuit was filed in Alameda County Superior Court against the City of Fremont. The lawsuit states the family is seeking an undisclosed amount of damages, as the exact cost of the girl’s treatment cannot be calculated due to her ongoing medical care.
